Can emergency work become permanent?

A great many emergency repairs become permanent, not because anyone decided they should, but because the emergency passed, the asset was in service, the budget moved on, and nothing forced the question.

That is a bad way to arrive at a permanent structure. It is also avoidable, because the decision that matters is made during the event, not after it.

Ask the question on day one

The useful move is to ask, while the work is being scoped: is there any prospect of this staying?

If the honest answer is yes — and it usually is — then the follow-up is whether it can be done to a permanent standard now, within the constraints of the emergency.

Often it can, and this is the point most worth understanding: armor placed to a permanent standard is frequently the same work at the same cost as armor placed as a stopgap. The difference is not the quantity of material. It is whether it was sized, extended, and keyed the way a permanent design would be.

The three details that decide it

From why scour protection fails, the things that separate protection that lasts from protection that does not:

Extent. Does it cover the affected footprint, or just the visible hole? Stopping at the hole is the classic emergency defect, and the new edge becomes the next failure. Extending past it costs more units and no extra mobilisation.

Toe. Is the bottom edge keyed below the level the bed may reach, or sitting on the surface? A toe that is not keyed will be undermined at the next event.

Terminations. Are the flanks and crest tied into ground that is not being attacked, or do they stop at a line where flow can get in? The crest in particular tends to be placed to today’s water level rather than to the design event.

Getting those three right during an emergency is mostly a matter of deciding to, not of having more time.

What has to be true for it to stay

It has to be the right system for the permanent duty. A product suited to rapid placement in flowing water may or may not be the one a considered design would have selected. Sometimes it is; sometimes the emergency constrained the choice.

It has to be sized for a design event, not for the condition on the day. Armor placed against the water level in front of you during a receding flood is sized for the wrong thing.

It has to be documented. What was placed, where, in what quantity, at what elevations. Without that record it cannot be assessed later and cannot be certified.

It has to be inspected once conditions allow, against what a permanent installation would be checked for. See post-flood scour inspection.

The permitting position has to be resolved. This is the one most often left hanging.

The permitting position

Emergency authorisation covers what the emergency required. It does not automatically authorise a permanent structure.

Depending on the agency and the situation, converting emergency work into permanent work may require:

  • After-the-fact documentation of what was actually done
  • A standard permit obtained retrospectively for the work that remains
  • A determination that what was placed is acceptable as permanent, or a requirement to modify it
  • Removal of anything that exceeded what the emergency required

That last one is the reason to place the minimum necessary during an event, and to place it well rather than placing more of it. Work beyond the emergency need is unauthorised work.

The practical advice: raise the question with the agency early, ideally during or immediately after the event. An agency asked “we would like this to remain, what do we need to do” is in a very different conversation from one that discovers two years later that a temporary authorisation was never closed out.

When it should not stay

Be honest about these:

  • The system was chosen for speed, not suitability. Sometimes the emergency dictated a choice that a considered design would not have made.
  • It was sized for the wrong event.
  • It narrows the waterway more than a permanent design would accept — particularly at a bridge, where it worsens the contraction and may fail a no-rise test. See floodplain permitting and no-rise.

  • It was placed with no record, so nobody can say what is there.

The hybrid position

A common and sensible outcome: the emergency work stays as part of the permanent solution, supplemented later.

Toe armor placed in an emergency, extended and completed in a subsequent work window, with the slope above treated then — that is a phased permanent repair whose first phase happened under emergency conditions. It is a good outcome and it is worth naming as the plan rather than letting it happen by default.

The decision to make deliberately

At the end of the emergency, one of three things should be written down:

  1. This stays, and here is the permitting and documentation to close it out
  2. This stays as phase one, and here is what phase two is and when
  3. This is temporary, and here is when it comes out and what replaces it

What should not happen is none of the above, which is how a stopgap becomes a permanent structure nobody assessed.
